Is It Legal to Wild Camp in Scotland? Your Right to Roam, Explained

That freedom comes from the Land Reform (Scotland) Act 2003, which gave everyone a statutory right of responsible access to most land and inland water in Scotland — not just a right to walk through it, but a right to be on it, including overnight. The detail of what “responsible” looks like is set out in the Scottish Outdoor Access Code, maintained by NatureScot.

What the Access Code Actually Asks of You

The Code defines wild camping as lightweight, done in small numbers, and only for two or three nights in any one spot. In practice, that means:

• Small tents, small groups – think two or three tents, not a festival.
• Two to three nights maximum in any one place, then move on.
• Leave no trace – pack out all rubbish, bury human waste well away from water sources, and don’t damage vegetation.
• Steer clear of farmland, crops, and gardens unless you have the owner’s permission.
• Respect privacy and wildlife – keep your distance from houses, and take extra care during deer stalking or grouse shooting season.

One nuance worth knowing: the right to roam covers people on foot with tents. It does not extend to motorhomes or campervans staying overnight in the wild — that’s covered by separate road and parking rules, so don’t assume the same freedom applies if you’re travelling by vehicle.

The One Big Exception: Loch Lomond & The Trossachs

Scotland’s busiest national park is the one place standard wild camping rules don’t automatically apply. Within its Camping Management Zones — specific lochside stretches covering a small fraction of the park — you’ll need a permit between 1 March and 30 September, currently costing £4.50 per tent (or motorhome) per night, bookable up to four weeks ahead via the park authority’s website. Outside those zones, and outside those dates, the ordinary Access Code applies and camping is free, as it is everywhere else in Scotland.

A good starting point for both wild camping and onward hikes on the West Highland Way — just remember the permit rules above if you’re inside the management zones.
